Welcome to ZAVIOR. This page (together with the documents referred to in it) tells you the terms of service (the “Terms”) which apply when you use the ZAVIOR service ("Service") from our website zavior.com or mobile applications and related platforms (collectively referred to as an “Application”).
ZAVIOR.com is operated by ZAVIOR Limited, a company incorporated and registered in England and Wales, whose registered office is at 19 Avondale Road, London, SE9 4SN, United Kingdom. Our Company registration number is 13670692. You may contact us at info@zavior.com.
Please read these Terms carefully before creating a ZAVIOR account or using our Applications. If you have any questions relating to these Terms please contact info@zavior.com.
We may modify the Terms of Service from time to time. Please read the Terms of Service and check back often. If you do not agree to any change to the Terms of Service then you must immediately stop using the site. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.
Acceptance of these Terms. By accessing or using our Application and Service, you confirm that you accept these Terms.
1. Definitions
1.1 “Application” means the ZAVIOR website, mobile application and related platforms where Users can access the Service.
1.2 “Consultations” means lifestyle and wellbeing professionals that are providing Users with fully-paid consultation.
1.3 “Consultation Fee” means the financial amount paid by the User to connect and engage with the Expert.
1.4 “Content” means any and all messages, photos, video, audio, images, data, information, text, communications, materials, documentation, and/or content.
1.5 “Experts” means third party lifestyle and wellbeing professionals that users can connect and engage with through Consultations purchased via the Service
1.6 “Service” means any service we provide or make available to you in connection with your use of ZAVIOR
1.7 “Third Party Content” means Content that originates from and/or is owned or provided by individuals, persons, or entities other than ZAVIOR which is made available through or in connection with the Service and/or Consultations
1.8 “Users” means anyone that has accessed or utilises the Service
1.9 “User Submissions” means any and all Content and reviews regarding the Services submitted, transmitted and/or otherwise provided or made available by or on behalf of Users in connection with the use of the Service and/or any Consultations
2. Eligibility. You must be at least 18 years old to use the Service and/or create an account. In order to make purchases on the site you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.
The site is available only to individuals and others who meet the ZAVIOR terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to ZAVIOR, whose applications are acceptable to ZAVIOR and who have authorised ZAVIOR to process a charge or charges on their credit/debit card in the amount of the total purchase price for the Service which they purchase.

3. Changes and Modifications. ZAVIOR reserves the right to either temporarily or permanently modify, suspend, remove or discontinue the Service at any time with or without notice (for various reasons including but not limited to the unexpected unavailability of an Expert). You will not be charged for any Services canceled by us, and we will reimburse you for any payment already made using the same method you used to pay for your order.
4. Creating and Managing an Account
4.1 Accounts. To access and use certain features of our Service you may need to create and register an Account. In registering an Account, you agree to provide and maintain up to date information that is true, accurate, current, up to date, and complete. When you open an account you may create a password, or other secure login method, and may also have to provide credit card details.
4.2 Account Security. You must keep any password you create, or other secure login method, secret, and prevent others from accessing your email account or mobile phone. If another person uses these methods to access your account, you will be responsible to pay for any Services they order, and we are not responsible for any other losses you suffer, unless the person using your password obtained it because we did not keep it secure. You agree to notify us immediately of any unauthorised use of your account.
4.3 Account Closure. You may close your account at any time by requesting to do so by contacting us at info@zavior.com. We may suspend your access to your account, or close it permanently, if we believe that your account has been used by someone else. We may also close your account if in our opinion you are abusing our Service (for example, by repeatedly applying for refunds or credit to which we do not consider you are entitled, making repeated unreasonable complaints, mistreating our staff, or any other good reason). If we close your account permanently we will refund any remaining account credit you have validly obtained from our customer service team or Application, by applying a credit to your registered credit card, or if that is not possible for any reason, by way of a bank transfer using bank details (provided you have supplied them to us).
5. Communications and User Submissions
5.1 Electronic Communications. By using the Service, you consent to receiving electronic communications from ZAVIOR including text messages, notifications and emails as part of the delivery of the Consultation and Service.
5.2 User Submissions. You acknowledge and agree that you, and not ZAVIOR, are solely responsible for any User Submissions submitted, transmitted and/or contributed by you, including the legality, reliability, accuracy and appropriateness of such User Submissions. By providing User Submissions, you represent and warrant that: (a) you own or control all rights in and to User Submission; (b) you have obtained all permissions and/or approvals as may be necessary or required to transmit User Submissions, or any personally identifiable information therein, in connection with the use of the Service and/or Consultations; and (c) all User Submissions do and will comply with these Terms.
6. Consultations From Experts. The terms and conditions set forth in this Section 6 shall apply to you if you engage with and/or purchase any Consultations from an Expert through the Service.
6.1 Consultations. The Service enables users to connect with Experts and purchase Consultations from such Experts. If you decide to engage an Expert you acknowledge and agree that you will be required to and shall pay the applicable fees for the Consultation purchased by you specified in the order submitted by you to engage such Expert (the “Consultation Fee”). The Consultation Fee shall be paid through the payment processing methods available through the Service. You agree that you will not indirectly or directly offer or solicit any Experts, or accept any offer or solicitation from an Expert, to invoice, pay, or receive payment of the Consultation Fee or any other fees and/or amounts in any manner other than through the Service.
6.2 Consultation Cancellations and Rescheduling. Subject to these Terms, you may cancel a standard consultation (i.e. instant messaging using text, pictures, recorded video and voice notes) order anytime before an Expert has started their response for a full refund by issuing your cancellation request on email at info@zavior.com. Any cancellations made after a response has commenced or been given will be charged in full. For live video consultations (pre-scheduled live video consultations), you can cancel or reschedule a Consultation up to 72 hours before the scheduled time of the Consultation for a full refund by issuing your cancellation request on email at info@zavior.com. If you cancel or request a reschedule less than 72 hours before your Consultation, you will be charged in full. In addition, you are allowed one cancellation and one reschedule between each completed Consultation. Any cancellations and/or reschedules beyond that will politely be declined and charged in full.
6.3 Service Availability & Delivery. Each Expert has a target response time, as detailed within the Expert’s Consultation details. The response time will likely be sooner, but in unforeseen instances there might be a delay in providing an initial response to your question. If that should occur we will notify you of the delay and offer you the right to cancel the Service for a full refund.
7. Your Dealings with Experts
7.1 Identity Disclaimer. For an individual to be considered an Expert and feature on the ZAVIOR Service, we will have performed basic research of information publicly available and will have evaluated their suitability before being accepted to the platform. ZAVIOR does not conduct any detailed background checks and nor do we represent, warrant or guarantee the identity of any Experts. You are solely responsible for making your own decisions about the suitability of Experts whom you contact, communicate, transact or interact with in connection with your use of the Service.
7.2 Your Dealings with Experts. You acknowledge, understand, and agree that, except solely with respect to ZAVIOR’s payment processing with respect to the fees paid by you through the Service for Consultations, shall be solely between you and the applicable Expert, and ZAVIOR shall not be a party to any Consultations, or have any responsibility or liability for such Consultations and the performance of the applicable Expert. You further acknowledge, understand and agree that any problems or disputes between you and any Expert are between you and any Expert and must be resolved solely between you and such Expert. ZAVIOR does not warrant, endorse, guarantee or assume responsibility for any Expert and the performance of any services and in any way monitor and transaction, engagement or relationship between you and any Expert. Your use of and engagement with any Expert shall be at your sole and entire risk. ZAVIOR is not and shall not be responsible for any loss, harm or damage of any sort incurred as a result of any such dealings or otherwise arising from your disputes and you agree that ZAVIOR is under and has no obligation to become involved in any such disputes.
7.3 Release. By using our Service you acknowledge and accept that ZAVIOR and its employees, agents, representatives, shareholders, officers, directors, affiliates, contractors, licensors, suppliers, successors and assignees are harmless from and waive any and all claims (including but not limited to claims for property damage, personal injury, or death) demans, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to consultations and your dealings or disputes with Experts.
8. Feedback. You acknowledge that any ideas, suggestions for improvement or discussions submitted by you regarding any aspect of the Service (but excluding your User Submissions), and any reviews you post regarding the Service (“Feedback”) may be used by ZAVIOR without compensation or attribution to you, and you hereby grant ZAVIOR to use and exploit for any purpose.
9. Payment.
9.1 Fees for the Consultations. The fees payable by you in connection to your use of the Service and the purchase of Consultations shall be set out in the checkout page when completing your order. You agree to, and shall, pay ZAVIOR, and hereby authorize ZAVIOR and its third payment processors to charge you, the fees, charges and taxes, specified to the order. You will be asked to supply certain information relevant to your order including your credit/debit card details, your billing address, email address, mobile number and contact name. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) provided by you in connection with any Order. By submitting such information, you grant ZAVIOR the right to provide such information to our third party service providers for purposes of facilitating the completion of Orders initiated by you or on your behalf.
9.2 Gift Cards. We may offer the ability to purchase gift cards (“Gift Cards”) for use to purchase Consultations through the platform. All Gift Card purchases are non-refundable. Gift Card purchases are solely redeemable for a Consultation or a portion of a Consultation.
9.3 Changes to Fees & Payment Terms. We may at any time and from time to time, in our sole discretion, change the fees, pricing models, charges, and/or payment terms, or add new fees, pricing models, charges, and/or payment terms applicable to the Service and Consultations.
10. Third Party Integrations. ZAVIOR may integrate and/or enable you to utilise certain third-party products, services and/or applications in connection with the use of the Service which are not owned, controlled, or operated by ZAVIOR and are subject to separate terms and conditions. Your use of any Third-Party Integrations is governed by the terms and conditions, terms of service, and/or similar end user agreements of the respective service providers. You are solely responsible for reviewing and complying with the applicable terms of service and privacy notices for such third-party integrations. Failure to comply may result in the termination of your account with a third-party integration provider and inability to use a particular feature or service we offer.
11. Indemnification. You agree to, and shall indemnify, defend and hold harmless ZAVIOR, its employees, contractors, service providers, vendors, and/or agents, from and against any and all claims, actions, demands, liabilities, losses, damages, expenses, and costs arising from (a) your breach of these Terms and/or any other Additional Terms, (b) violation of any license or other agreement applicable to any Third Party Integrations; (c) failure to perform and/or comply with your obligations and responsibilities applicable to any Consultations purchased by you, (d) your use or alleged misuse of Service (or any part thereof) and/or any Service Content, (e) your use and/or misuse of the Consultations you purchase, (f) your User Submissions; and/or (g) any of your dealings with Experts and your disputes.
12. Disclaimers of Warranties & Limitations on our Liability
12.1 Disclaimers of Warranty. The Service, Service Content, Consultations and any other materials provided by ZAVIOR are all provided “as is” and “as available”. ZAVIOR and its licensors and suppliers hereby expressly disclaim any representations, warranties or guarantees of any kind, express or implied, including warranties of title, quality. Merchantability, fitness for any particular purpose, satisfactory purpose, accuracy, non-infringement and any warranties and conditions that may arise from course of dealing, course of performance or usage of trade. ZAVIOR and its licensors and suppliers do not warrant or make any guarantee that defects will be corrected or that the Service, Service Content, Consultations or any other materials provided by ZAVIOR or in connection with the Service will meet your requirements; will be compatible with your home network, computer or mobile device, or any third party integrations; will be available on an uninterrupted, timely, secure or error-free basis; or will be accurate or reliable. No advice or information, whether oral or written, obtained by you from ZAVIOR, and third parties, including any Experts through the Service, any Service Content and Consultations, shall create any warranty.
12.2 Limitation of Liability. ZAVIOR will not be liable, in contract, tort (including, without limitation, negligence) or otherwise pursuant to or in connection with these terms for: any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); any loss of goodwill or reputation; or any special, indirect, inconsequential, exemplary, incidental or punitive losses,suffered or incurred by you out of or in connection with the provision of any Service or under these terms. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence or fraud.
